1. Acceptance of Terms
By downloading, installing, or using DockNest ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a binding agreement between you and the developer of DockNest ("[Developer Name]", "we", "us", or "our").
2. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use DockNest solely for your personal, non-commercial purposes on Apple-branded devices you own or control, in accordance with Apple's usage rules set forth in the App Store Terms of Service.
3. Restrictions
You may not:
- Copy, modify, or distribute DockNest or any portion of it
- Reverse engineer, decompile, disassemble, or attempt to derive source code
- Rent, lease, lend, sell, or sublicense the App to any third party
- Remove or alter any proprietary notices, labels, or marks on the App
- Use the App for any unlawful purpose or in violation of any regulation
- Use the App in a way that violates Apple's App Store Guidelines
4. Intellectual Property
DockNest and all related content, features, and functionality (including but not limited to all information, software, text, graphics, logos, and icons) are owned by [Developer Name] and are protected by applicable intellectual property laws. These Terms do not grant you any rights to trademarks, service marks, or other intellectual property of the developer.
5. Updates and Changes
We may, from time to time, issue updates to DockNest. Updates may add, modify, or remove features. You agree that we may make such changes at our sole discretion. Continued use of the App after an update constitutes acceptance of the updated version.
6. Disclaimer of Warranties
DockNest is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The App will meet your requirements or expectations
- The App will be uninterrupted, error-free, or free of viruses
- Defects in the App will be corrected
7. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use the App
- Any changes made to the App or any temporary or permanent cessation of the App
- Any unauthorised access to or alteration of your data
Our total liability to you for any claim arising out of these Terms shall not exceed the amount paid by you for the App in the twelve (12) months preceding the claim.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey. Users in the European Union retain the right to pursue claims before their local courts.
9. App Store Terms
DockNest may be distributed through the Apple Mac App Store. Your use of the App is also subject to Apple's App Store Terms of Service. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail to the extent of the conflict.
10. Termination
We may terminate or suspend your license to use DockNest immediately, without prior notice, if you breach any provision of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
